Canadian Armed Forces Racial Discrimination Settlement: What the Claim Pays

September 25, 2026 · 4 min read

The Canadian Armed Forces racial discrimination and racial harassment class action settlement pays a common experience payment of C$5,000 for each approved claim. Claimants who choose to describe their experiences can also be assessed for an additional amount, for a total of up to C$35,000. Claims go to the administrator at classaction.deloitte.ca, and the deadline is October 15, 2026.

The payout: C$5,000 at the base level

The settlement sets a base payment of C$5,000 for an approved claim. That is the figure to plan around if you are deciding whether to file.

The additional amount comes in three levels, and asking for it is optional. A claimant can describe experiences of racial discrimination or racial harassment connected with their service in a separate section of the claim form. Independent assessors then decide whether an additional payment applies, looking at the duration and severity of the impacts on dignity, bodily or emotional integrity, spiritual well-being and relationships.

Treat C$35,000 as the top of the scale, not an expectation. Whether a claim reaches any additional level depends on what the claimant submits and how the assessors weigh it.

Why the final amount can differ from the headline figure

Two things move the number on an individual cheque. The first is the administrator's review. A court-appointed administrator reads each claim and decides whether it qualifies at all, and independent assessors decide whether an additional level applies. A claim can be approved at the base level, approved with an additional level, or rejected.

The second is the volume of valid claims. The administrator calculates the total of all assessed amounts only after the claim period ends and every decision has been made. Nobody can tell you your exact payment before that process is finished.

The administrator describes a single, one-time issuance of payments once every claim is decided and the amounts are calculated. It is not ongoing money.

Who may be eligible

The class covers current or former Canadian Armed Forces members who experienced racial discrimination and/or racial harassment in connection with their military service at any time between April 17, 1985, and January 10, 2025.

The class action was brought against the Department of National Defence in the Federal Court of Canada under case number T-1657-19. The lawsuit alleged racial discrimination and racial harassment within the CAF. A settlement resolves a case without the court ruling on those allegations.

If your service and experience fall inside that window, you may be eligible. Whether you actually qualify, and at what level, is a decision for the court-appointed administrator and nobody else.

How and when to file

Claims are filed directly with the administrator at classaction.deloitte.ca. There is no charge to submit a claim. You do not need to pay anyone to do it on your behalf.

The deadline is October 15, 2026. A claim that arrives after the deadline can be refused outright, no matter how strong it is, so the date matters as much as the content.

One rule matters more than it looks. The administrator says that once a claim is submitted, no additional information or documentation can be accepted. If you want to be considered for an additional level, complete that section of the form and send it together with the rest of the claim, not afterwards.

You can confirm every detail here yourself: the case is T-1657-19 in the Federal Court of Canada, and the official claims information is at classaction.deloitte.ca.

Common questions

Will I get C$35,000?

Not automatically. The C$5,000 common experience payment is the base for an approved claim. Claimants who choose to describe their experiences in the claim form can be assessed for one of three additional levels, and the highest level brings the total to C$35,000. Independent assessors decide whether any additional amount applies, based on the duration and severity of the impacts described.

How do I know if I qualify?

The class covers current or former Canadian Armed Forces members who experienced racial discrimination and/or racial harassment in connection with their military service at any time between April 17, 1985, and January 10, 2025. If that describes you, you may be eligible, but only the court-appointed administrator can decide.

Does it cost anything to claim?

No. Filing through the administrator at classaction.deloitte.ca is free. Anyone asking for a fee to submit this claim for you is not necessary to the process.

Did a court find that the Department of National Defence did something wrong?

The class action claimed racial discrimination and racial harassment within the Canadian Armed Forces. The case, T-1657-19 in the Federal Court of Canada, resolved through a settlement. A settlement is not a court finding of wrongdoing.

What happens if I miss October 15, 2026?

That is the claims deadline: the claim period closes at 11:59 p.m. Pacific time on October 15, 2026. Claims submitted after it can be refused, so if you intend to file, do it before that date rather than after.
